Mickey Beisman specializes in
diverse areas of construction from building projects to office and parking structures to public projects. She has over 20 years experience in construction law and, for this reason, knows private and public bidding requirements, bonding and mechanic's lien requirements, private and public specifications, and varying forms of project delivery systems from design-bid-build to design-build to construction manager at-risk and construction manager not-at-risk.
Because of her experience representing
private owners, including developers, public owners,
contractors,
subcontractors, and designers, Ms. Beisman has
particular expertise in bidding and payment disputes, construction delays, trade coordination, subcontractor substitution, the Resident Contractors Preference Act, change orders, requests for information, changed conditions, design criteria, and, essentially, all the areas in a straightforward or a complex construction project.
Based on her experience in construction law, Ms. Beisman offers the following Practical Tips:
1. DEVELOPERS AND OTHER PRIVATE OWNERS SHOULD KNOW THE TRACK RECORDS OF ANY CONTRACTORS AND PROPOSED SUBCONTRACTORS BEFORE SIGNING A CONTRACT WITH THE CONTRACTOR;
2. A PUBLIC OWNER WITH ITS OWN PERSONNEL ON-SITE SHOULD KEEP A CAREFUL RECORD OF ALL JOB ACTIVITIES;
3. A CONTRACTOR SHOULD REQUIRE SUBCONTRACTORS TO ATTEND ALL RELEVANT WEEKLY MEETINGS; AND
4. A SUBCONTRACTOR SHOULD KNOW IF THERE IS A "FLOW-DOWN" CLAUSE WHICH BINDS HIM TO THE CONTRACTOR UNDER THE SAME TERMS THAT THE CONTRACTOR IS BOUND TO THE OWNER
